Freight Damage/Parcel Damage
Any damage from shipping or freight should be communicated to BoatMaxOnline within three
days after the goods are received. The buyer is responsible for identifying and documenting any
damage before signing the delivery receipt. Should the outboard be damaged, the purchaser must
record this before acknowledging delivery. The customer must accept the delivery regardless of
any damage found. In case of any freight or shipping damage, all original packaging materials,
including external packaging, internal Styrofoam, bubble wrap, and cardboard supports must be
kept safe by the customer. If the product was damaged during shipping and the customer notified
BoatMaxOnline promptly, CWS will file a claim with the shipping company, and we will work
with you to determine a satisfactory solution to correct the issue. However, BoatMaxOnline is
not responsible for any damage or loss outside of its control, and such instances won't be grounds
for canceling or refusing shipments.

Product Availability
All orders placed with BoatMaxOnline, whether via this website, phone or other methods,
depend on the availability of the products. If you order a product that is not in stock, you will be
notified and given the choice to either backorder the product or cancel your order. We aim to
process every order as soon as possible. Still, we cannot guarantee the availability of all products
and hence, BoatMaxOnline cannot be held accountable for any losses, costs, damages, charges,
or expenses resulting from a product being unavailable. Our commitment is to deliver all
products within the given timeframe, but delays that are beyond our control can occur. The
delivery dates we provide are only estimations, and BoatMaxOnline shall not be held responsible
for any losses, costs, damages, charges or expenses caused by any delays in delivery. Any
reasonable delays beyond BoatMaxOnline’s control do not constitute a reason for waiving the
cancellation policy stated herein.
Back Order Arrival Dates
The manufacturers provide the delivery dates, and should be considered estimates only. The
predicted arrival and availability dates can change without prior notice and are not guaranteed.

Typographical Error
Suppose there is a misprint or error in the product or pricing information due to a typing mistake
or incorrect information provided by our suppliers. In that case, BoatMaxOnline won't be
responsible for the error and retains the right to reject or cancel the order. Such a mistake will not
be grounds for the customer to waive, cancel, return, or exchange their order.
Incorrect, Invalid and Otherwise Undeliverable Addresses
You affirm and confirm that the addresses provided in your order are legitimate physical street
addresses that are reachable and serviceable by FedEx Ground and UPS Ground. All outboards

must be shipped to a physical street address and cannot be shipped to a PO Box. Any shipment
that cannot be delivered or is undelivered due to an unrecognized or incorrect address does not
result in the waiver of any term, provision, or condition in this agreement. Any undeliverable or
undelivered shipment will be defined as an undeliverable shipment per this agreement. It will be
subjected to all the associated fees and costs as outlined herein.

Free Shipping Requirements and Other Shipping Restrictions
Any order totaling $90 or more will be eligible for free standard ground shipping in the Lower
48 States. However, orders with excessive weight and/or size might be subject to an additional
freight charge. This includes orders shipped to locations requiring air or water/ferry service for
delivery, military bases, government buildings, schools, hospitals, corporate campuses, and other
locations with limited access or security checkpoints. A signature upon delivery is mandatory
and cannot be used to waive or alter any cancellation, delivery refusal, or undeliverable shipment
stipulations of the website's terms and conditions. Furthermore, outboard products delivered by
freight are only eligible for lift gate services from the freight company if explicitly stated and
paid for during checkout. Free shipping includes either standard ground or freight, based on the
product. Standard ground shipping delivers to a residential or commercial entry door, while
standard freight shipping delivers to a given address, be it a driveway or street-side, but doesn't
include delivery to an entry door or lift gate services. Lift gate service can be purchased at
checkout.
Cancellations / Refused or Undeliverable Shipments
This clause applies ONLY to all transactions processed but the goods have yet to arrive at the
buyer's location. For cases where the goods have been delivered, please refer to the "PRODUCT
EXCHANGES & RETURNS" section. All cancellations of orders necessitate a written request
via email. Any transaction that has incurred a charge on the buyer's credit card (notably when the
BoatMaxOnline charge is settled - irrespective of the time the charge is reflected on the buyer's
account) is considered processed in relation to this clause and this website. If your order has been
processed, a restocking fee will be applied. All parts are subject to a 10% restocking fee. If a
shipment has been dispatched, all shipping costs (including the initial shipping charges AND the
return shipping fees) will be borne solely by the buyer and subtracted from any credit issued. For
all refused or undeliverable shipments, a 10% restocking fee will be levied in addition to all
shipping expenses.

Product Exchanges and Returns

Customers who shop at BoatMaxOnline have the opportunity to return products within 60 days of receiving them. For a full refund, the returned products must be in their original, unused condition. It's important for customers to understand that products which have been used, damaged, or altered after receipt will not qualify for a full refund.

All outboard motors are protected by a 5-year warranty, and most electronics come with a 2-year warranty.
